These Terms and Conditions (“Terms”) govern your access to and use of Boskify’s website, merchant dashboard, APIs, and related services (the “Services”). By creating an account or using the Services, you agree to these Terms.
1. The Services
Boskify is a software platform that helps exchange merchants manage payments, orders, ads, and chat workflows. Features may include Auto Payment, AdBot, Auto Mark Paid, AI chat follow-ups, wallets, and connections to exchanges and payout providers. Availability of features may depend on your plan (for example Starter or Premium) and which integrations you configure.
2. Eligibility and accounts
You must be legally able to enter a binding contract and use the Services only for lawful business purposes. You are responsible for the accuracy of registration information, for safeguarding your credentials and transfer PIN, and for all activity under your account.
3. Exchange and bank connections
You may connect third-party exchanges and payment rails by providing API keys or other credentials. You authorize Boskify to use those credentials solely to perform actions you enable (such as reading orders, marking paid, adjusting ads, or initiating payouts). You remain responsible for complying with each third party’s terms, fees, limits, and risk rules. Boskify is not those third parties and does not control their uptime or policies.
4. Automation and AI features
Automation and AI features act according to settings you configure. You are responsible for reviewing outcomes, intervening when needed, and ensuring counterparties, amounts, and bank details are correct. Name checks, retries, and chat replies reduce risk but do not eliminate fraud, mismatch, or exchange-side failures. Boskify does not guarantee any particular volume, profit, or settlement result.
5. Fees and Premium
Some features are included; others (such as AdBot, AI chat replies, and Auto Mark Paid) may require a paid Premium subscription or other fees disclosed in-product. High-volume promotional unlocks, if offered, are subject to the criteria stated on the pricing or subscription pages. Fees are non-refundable except where required by law or expressly stated by Boskify.
6. Acceptable use
You agree not to misuse the Services, including by attempting unauthorized access, reverse engineering except as permitted by law, interfering with other users, submitting unlawful content, or using the platform for money laundering, sanctions evasion, or other illegal activity. We may suspend or terminate accounts that violate these Terms or create risk to the platform or other users.
7. Intellectual property
Boskify and its licensors own the Services, branding, and software. You receive a limited, non-exclusive, non-transferable right to use the Services for your internal business while these Terms remain in effect. You retain rights to your own data; you grant us a license to process that data as needed to provide the Services.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOSKIFY DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that third-party exchanges or banks will behave as expected.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOSKIFY AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICES WILL NOT EXCEED THE FEES YOU PAID TO BOSKIFY IN THE THREE MONTHS BEFORE THE CLAIM.
10. Indemnity
You will indemnify and hold Boskify harmless from claims arising out of your use of the Services, your exchange or bank connections, your counterparties, or your violation of these Terms or applicable law.
11. Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Services. Provisions that by nature should survive (including liability limits, indemnity, and intellectual property) will survive termination.
12. Changes
We may update these Terms by posting a revised version on this page. Material changes may also be communicated in-product or by email. Continued use after the effective date constitutes acceptance.
